These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for providing this application and define the rights and obligations between the Company and users.

By using this application, you must read and agree to the full text of these Terms.

These Terms are originally written in Japanese, and an English translation is provided. In the event of any inconsistency or difference in interpretation between the Japanese version and the English version, the Japanese version shall prevail.

Article 1 (Scope)

  • (1) These Terms aim to define the conditions for providing this application and the rights and obligations between the Company and users, and shall apply to all relationships related to the use of this application.
  • (2) In addition to these Terms, the Company may establish separate provisions on this website. Regardless of their name, these provisions shall constitute a part of these Terms.
  • (3) In the event of any inconsistency between these Terms and the separate provisions, the separate provisions shall prevail unless otherwise specified.

Article 2 (Definitions)

The following terms used in these Terms shall have the meanings set forth below:

  • (1) “Terms” means these Terms of Service.
  • (2) “Application” means the application provided by the Company under the name “BuzzerTalk” (including any modified versions regardless of changes in name or content).
  • (3) “Website” means the website operated by the Company that contains information about the Application.
  • (4) “User” means a person who uses the Application.
  • (5) “User Data” means all data stored by users through the Application.
  • (6) “Company” means m7soft.

Article 3 (Agreement to Terms)

  • (1) By using the Application, users are deemed to have agreed to these Terms.
  • (2) Users must use the Application in accordance with these Terms and may not use it unless they agree.
  • (3) This service is not intended for individuals under 13 years of age (or the age considered a child in their region), and such individuals are strictly prohibited from using it, even with parental consent. This service is intended for users aged 13 and above. Users under 18 (or the age of majority in their region) must obtain parental consent. This does not imply the service contains sexual or violent content. Note that installation eligibility may vary depending on app store age ratings.

Article 4 (Prohibited Actions)

Users shall not engage in any of the following actions, or actions deemed by the Company to fall under these categories. If such actions are confirmed, the Company may suspend usage without prior notice.

  • (1) Violations of laws or criminal acts
  • (2) Fraud or threats against the Company, other users, or third parties
  • (3) Actions against public order and morals
  • (4) Infringing intellectual property, portrait rights, privacy, reputation, or other rights
  • (5) Transmitting information via the Application that includes:
    • Excessively violent expressions
    • Harmful computer programs (e.g., viruses)
    • Defamation of others
    • Obscene content
    • Discriminatory content
    • Promotion of self-harm or suicide
    • Promotion of drug abuse
    • Anti-social expressions
    • Chain messages or spam
    • Content causing discomfort
  • (6) Excessive load on systems or networks
  • (7) Reverse engineering or analysis of systems
  • (8) Copying, modifying, altering, or disclosing systems
  • (9) Interfering with operation
  • (10) Unauthorized access (including direct server access)
  • (11) Impersonation
  • (12) Unauthorized advertising or solicitation
  • (13) Collecting user information outside provided features
  • (14) Causing harm or discomfort
  • (15) Violating separate provisions
  • (16) Supporting anti-social forces or use by such forces
  • (17) Using for dating purposes with strangers
  • (18) Use during unsafe situations (e.g., driving)
  • (19) Inducing the above actions
  • (20) Attempting the above actions
  • (21) Other inappropriate actions as determined by the Company

Article 5 (Suspension)

The Company may suspend or interrupt the Application without notice if:

  • (1) System maintenance is required
  • (2) Failures, overload, or cyberattacks occur
  • (3) Force majeure events occur
  • (4) The Company deems it necessary

Article 6 (Ownership)

  • (1) All intellectual property belongs to the Company or licensors, and use of the Application does not grant such rights.
  • (2) Users represent that they have lawful rights to their data.
  • (3) Users grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use data for service operation and promotion.
  • (4) Users agree not to exercise moral rights.
  • (5) The Company respects privacy and will not publicly disclose identifiable data.

Article 7 (Withdrawal)

  • Users may withdraw by deleting the Application.
  • Deletion does not automatically remove server data.
  • Data types:
    • (1) Company-managed data
    • (2) Third-party managed anonymous data
  • Company data can be deleted via app features or request.
  • Third-party data deletion is not guaranteed.
  • User ID is required for deletion requests.

Article 8 (Changes and Termination)

  • (1) The Company may change the Application without consent.
  • (2) The Company may terminate the service with notice.
  • (3) Business transfers will be notified.

Article 9 (Disclaimer)

  • (1) No guarantees regarding functionality or suitability.
  • (2) No liability for data loss.
  • (3) No guarantee of compatibility.
  • (4) No liability for damages.
  • (5) User disputes are their own responsibility.
  • (6) No responsibility for SNS-related issues.
  • (7) No responsibility for accidents or health issues.
  • (8) No guarantee of notification delivery.
  • (9) No guarantee of data preservation.

Article 10 (Confidentiality)

Users must keep confidential information secret unless approved.

Article 11 (User Information)

  • (1) Governed by privacy policy.
  • (2) Statistical use allowed.
  • (3) No monitoring unless justified.

Article 12 (Advertisements)

  • (1) Ads may be displayed.
  • (2) No responsibility for ad content.
  • (3) Data may be shared for ads/analytics.

Article 13 (Changes)

The Company may modify these Terms and notify users.

Article 14 (Contact)

  • (1) Communication via designated methods.
  • (2) Data breaches will be reported as required.

Article 15 (Transfer)

  • (1) Users cannot transfer rights.
  • (2) Company may transfer business and data.

Article 16 (Severability)

Invalid provisions do not affect remaining terms.

Article 17 (Governing Law)

  • (1) Governed by Japanese law.
  • (2) Tokyo District Court has jurisdiction.
