These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for providing this application and the rights and obligations between the operator and users.
You must read and agree to the full text of these Terms before using this application.
These Terms are originally written in Japanese, and an English translation is also provided. However, if any inconsistency or difference in interpretation arises between the Japanese version and the English version, the Japanese version shall prevail.
Article 1 (Application)
- (1) These Terms are intended to define the conditions for providing this application and the rights and obligations between the operator and users regarding the use of this application, and shall apply to all relationships related to the use of this application.
- (2) In addition to these Terms, the operator may establish various individual provisions on this website. Regardless of their name, such provisions shall constitute a part of these Terms.
- (3) If the contents of these Terms conflict with the individual provisions described in the preceding paragraph, the individual provisions shall prevail unless otherwise specified.
Article 2 (Definitions)
The following terms used in these Terms shall have the meanings set forth below.
- (1) “Terms” means these Terms of Service.
- (2) “Application” means the application provided by the operator under the name “Moonlight Jigsaw.” (Including any application after changes to the name or content for any reason.)
- (3) “Website” means the website operated by the operator that contains information related to this application.
- (4) “User” means a person who uses this application.
- (5) “User Data” means all data saved by users through the use of this application.
- (6) “Operator” means m7soft.
Article 3 (Agreement to the Terms)
- (1) By using this application, users are deemed to have agreed to these Terms.
- (2) Users must use this application in accordance with these Terms and may not use the application unless they agree to these Terms.
- (3) This service is not intended for persons under the age of 13 (or the age considered a child in the user’s region), and such persons are strictly prohibited from using it, even with parental consent. This service is intended for users aged 13 and older. However, users under the age of 18 (or the age of majority in their region) must obtain parental consent before use. This does not mean the service contains sexual or violent content. Please also note that the actual installable age may vary slightly depending on the store’s age rating policies.
Article 4 (Prohibited Acts)
Users shall not engage in any of the following acts or any acts deemed by the operator to fall under the following categories while using this application. If such conduct is confirmed, the operator may suspend the user’s access to the application without prior notice.
- (1) Acts that violate laws or relate to criminal activity
- (2) Fraudulent or threatening acts against the operator, other users, or third parties
- (3) Acts contrary to public order and morals
- (4) Acts that infringe intellectual property rights, portrait rights, privacy rights, honor, or other rights or interests of the operator, other users, or third parties
- (5) Sending information through this application, social media, or to third parties that falls under or is deemed by the operator to fall under any of the following:
- Excessively violent or cruel expressions
- Information containing computer viruses or harmful programs
- Information damaging the reputation or credibility of the operator, other users, or third parties
- Excessively obscene expressions
- Expressions promoting discrimination
- Expressions encouraging suicide or self-harm
- Expressions encouraging improper drug use
- Anti-social expressions
- Information encouraging the spread of chain messages
- Expressions causing discomfort to others
- (6) Acts imposing excessive load on the network or systems of this application
- (7) Reverse engineering, analysis, or similar acts targeting the software, communications, or systems provided by the operator
- (8) Copying, modifying, altering, adapting, or disclosing the software or systems provided by the operator to third parties
- (9) Acts that may interfere with the operation of this application
- (10) Unauthorized access to the operator’s networks or systems, including directly connecting to servers without using the application
- (11) Impersonating third parties
- (12) Advertising, solicitation, or business activities using this application without prior permission
- (13) Collecting information of other users through methods other than features provided by this application
- (14) Acts causing disadvantage, damage, or discomfort to the operator, other users, or third parties
- (15) Acts violating individual provisions posted on the website
- (16) Providing benefits to anti-social forces or use of the application by anti-social forces
- (17) Acts intended to meet strangers of the opposite sex
- (18) Use of the application while driving, walking, or in situations requiring attention to surroundings
- (19) Acts that directly or indirectly induce or facilitate the above acts
- (20) Attempting any of the above acts
- (21) Any other acts deemed inappropriate by the operator
Article 5 (Suspension of the Application)
The operator may suspend or interrupt all or part of this application without prior notice to users if any of the following applies:
- (1) Emergency inspection or maintenance of systems related to the service
- (2) Inability to operate the application due to computer or communication failures, malfunctions, excessive access, unauthorized access, hacking, etc.
- (3) Inability to operate the application due to force majeure such as earthquakes, lightning, fire, storms, floods, power outages, or natural disasters
- (4) Any other case where the operator determines suspension or interruption is necessary
Article 6 (Intellectual Property Rights)
- (1) All intellectual property rights related to the website and application belong to the operator or licensors, and permission to use the application under these Terms does not imply a license to use such intellectual property rights.
- (2) Users represent and warrant that they have lawful rights to the User Data and that such data does not infringe third-party rights.
- (3) Users grant the operator a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works from, display, and perform User Data to the extent necessary for providing, maintaining, improving, or promoting the service.
- (4) Users agree not to exercise moral rights against the operator or parties succeeding or licensed by the operator.
- (5) The operator respects user privacy and will not publicly use information in a personally identifiable form.
Article 7 (Withdrawal)
- Users may withdraw from this application by deleting the application.
- Even after deletion, anonymous data managed by third-party services such as analytics or crash reporting may remain.
- Users may request deletion of data managed by third-party services through the inquiry form on the operator’s website. The operator will make reasonable efforts to delete such data but cannot guarantee complete deletion due to limitations of third-party services and their policies.
Article 8 (Changes or Termination of the Application)
- (1) The operator may change all or part of the application without prior consent from users. This may include changes to puzzle images, order, difficulty, UI, and all other aspects.
- (2) The operator may terminate the provision of the application at its discretion. Unless unavoidable circumstances exist, users will be notified in advance.
Article 9 (Disclaimer)
- (1) The operator does not guarantee that the application will meet users’ specific purposes, expected functions, commercial value, accuracy, reliability, usefulness, legal compliance, continuous availability, or freedom from defects.
- (2) The operator shall not be responsible for damage or loss of User Data caused by business reasons, overloads, malfunctions, maintenance, updates, app deletion, OS updates, legal changes, disasters, power outages, communication failures, unauthorized access, device changes, or other causes.
- (3) The operator does not guarantee that the application will function normally, display properly, launch successfully, or be updatable on all devices.
- (4) The operator shall not be liable for damages suffered by users in relation to this application.
- (5) The operator shall not be responsible for transactions, communications, or disputes arising between users and other users or third parties in relation to this application or website.
- (6) The operator shall not be involved in or responsible for damages, troubles, or disputes arising from the use of social media sharing features related to this application. Users must share content at their own responsibility.
- (7) The operator shall not be responsible for accidents, injuries, illnesses, or any other issues arising from use of this application. Users must pay sufficient attention to their own safety and refrain from use when necessary. Please especially be careful not to drop your smartphone on your face while using the application.
Article 10 (Fees)
- This application is provided as a paid application.
- Purchases and payments are processed through the payment systems of each platform provider.
- In addition to the listed purchase price, users are responsible for communication fees related to downloads, updates, viewing related pages, analytics, and other network usage.
- Due to the nature of digital content, returns, refunds, and exchanges are generally not available. However, refund policies established by platform providers may apply in exceptional cases.
- This application may use AI technology for certain image generation features. Returns, refunds, or exchanges based on the use of AI technology are not accepted.
- The operator may terminate or change the application for operational, technical, legal, or other reasons, including ending support for specific OS versions. If service provision ends, returns, refunds, or exchanges will not be available regardless of unused periods.
Article 11 (Confidentiality)
Users shall keep confidential any non-public information disclosed by the operator in connection with this application and requested to be treated confidentially, unless prior written consent is obtained from the operator.
Article 12 (Handling of User Information)
- (1) The handling of user information by the operator shall be governed separately by the Privacy Policy, and users agree that their information will be handled in accordance with that policy.
- (2) The operator may use information and data provided by users in a statistical form that does not identify individuals, at the operator’s discretion, and users shall not object to such use.
Article 13 (Changes to the Terms)
The operator may change these Terms when deemed necessary.
When changes are made, the operator shall notify users of the effective date and content of the revised Terms through posting on the website or other appropriate means.
However, if user consent is legally required for certain changes, such consent shall be obtained through methods designated by the operator.
Article 14 (Contact / Notifications)
- Inquiries regarding this application and notifications between users and the operator, including notifications regarding changes to these Terms, shall be made by methods specified by the operator.
Article 15 (Transfer of Contractual Status)
- (1) Users may not assign, transfer, create security interests in, or otherwise dispose of their contractual status or rights and obligations under these Terms to third parties without prior written consent from the operator.
- (2) If the operator transfers the business related to this application to another company, the operator may transfer the contractual status, rights and obligations under these Terms, and user information to the transferee, and users are deemed to have agreed in advance to such transfer.
Article 16 (Severability)
Even if any provision of these Terms or part thereof is determined invalid or unenforceable under consumer protection laws or other laws and regulations, the remaining provisions and the remaining portions of the invalid or unenforceable provision shall continue in full force and effect.
Article 17 (Governing Law and Jurisdiction)
- (1) These Terms and service agreements shall be governed by the laws of Japan.
- (2) Any disputes arising from or related to these Terms or service agreements shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
